Minimum Rental Period
The minimum period of rental is 7 days. At IrishTourism.com
we accept Visa, Mastercard and American Express credit cards.
On the day we mail out the phone to your first night's accommodation
in Ireland, or pickup point, we will advise you your assigned
phone number by email and the full rental amount plus handling
will be deducted from your credit card. We will also advise
you of the SDS tracking number of your phone, unless that phone
is hand delivered to the customer's pickup point.
2. Theft and Loss
We can arrange Theft and Loss Protection to cover loss, theft
and/or damage to your rented cell phone. The rate is 1.50 Euro
per day. A 20 Euro excess will be charged to all claims. If
Theft and Loss Protection is declined you are responsible for
a maximum of €300.00 if the equipment is stolen, lost
or damaged. In either case, a police report is requested should
the equipment be stolen.
3. Delivery
1. Delivery of the rented cell phone shall be deemed to have
been effected once it has been either :
(a) delivered to (or delivery has been attempted at) the address
specified by the Customer; or
(b) delivered to the Post Office indicated by IrishTourism.com
and specified by the Customer.
2. The Customer shall notify IrishTourism.com immediately if
delivery is not effected on the date specified by the Customer
in the Order Form.
3. We will make all reasonable efforts to deliver the rented
Cell Phone to the Customer on the date specified in the Order
Form but will not be liable for delays due to matters beyond
our control.
4. IrishTourism.com shall not be liable for late delivery caused
by the Customer providing the Company with an incomplete or
inaccurate delivery address. IrishTourism.com may verify the
delivery address provided by the Customer by verifying this
with the entity at the delivery address or by consulting authoritative
information on addresses. IrishTourism.com may use the address
information so obtained to correctly address the package in
the best interests of the Customer to effect delivery.
4. Late Delivery
The customer accepts that delivery may be late due to factors
outside the control of IrishTourism.com, eg strike, weather
etc. IrishTourism.com will refund the customer for days lost
due to late delivery. The customer agrees to accept delivery
on the next working day following the original agreed delivery
date at the location specified in the rental agreement. If the
customer has moved on, IrishTourism.com reserves the right to
cancel the order and offer a full refund.
5. Return
The customer agrees to return the rented cell by post on the
final day of the agreed rental period. If the return day is
a Sunday or a Bank Holiday, the phone must be returned on the
next working day. The customer must retain a copy of the proof
of postage provided by the post office.
6. Care
There are a large number of mobile/cell phones stolen every
year in Ireland. It is the customers responsibility to take
care of the phone. Do not leave it unattended, especially in
a car. Protect the phone from water and rain. Do not expose
the phone to excessive heat, especially on a car dash board.
7. Good Working Order
If at anytime the customer feels the rented cell phone is not
performing correctly, they must contact IrishTourism.com on
the contact number supplied with the phone. This contact number
is not manned on a 24hr basis, but there is a facility to leave
a message and we will contact you as soon as possible.IrishTourism.com
will not consider any refunds if we are not notified of any
problems.
We will do our utmost to resolve any issue as soon as possible.
If the issue cannot be resolved, we will either arrange for
a replacement phone to be shipped to the customer, or we will
refund the customer for the rental from the date IrishTourism.com
were notified of the problem.
8. Lost Or Stolen
In the event that the Equipment is lost or stolen, it is your
responsibility to immediately make a report to the local Gardai
and obtain a Garda report number which must be provided to the
us, together with the address and telephone number of the Garda
station in which the report was made. This report must be made
within 24 hours of the loss or theft occurring. If the equipment
is not returned to us and you have not taken out insurance then
you will become liable for the replacement costs of the Equipment.
9. Cancellation Policy
(a) If the order is cancelled before the rented cell phone is
shipped, an administration charge of 10 euro will be charged
to the customers credit card.
(b) If the order has shipped and is cancelled prior to the delivery
date specified and the customer has not taken delivery of the
order, then the customer will be charged an administration charge
of 25 euro plus the cost of all shipping charges and the cost
of any phone cards or call credit ordered.
(c) If the order is cancelled after the delivery date the customer
is liable for the full rental charge including insurance and
any additional call credit or phone cards ordered.
(d) IrishTourism.com may cancel an order if the information
supplied by the customer is not sufficient to process the order,
and or the customer cannot be contacted.
10. Early Number Allocation
All our phones are verified and checked before a phone number
is allocated to a customer. The phone number is allocated the
day the phone is shipped to the customers pick up point.
The phone number will be sent by email to the email address
specified in the rental agreement by the customer. If
you require early number allocation, it will mean allocating
the phone to you earlier, which will increase the rental period.
The daily rental rate will apply for each additional early day
requested.
11. Using the phone outside the Republic Of Ireland.
While our Cell Phones will work in most European Countries,
the customer must notify IrishTourism.com Ireland if they plan
to use the Cell Phone outside the Republic of Ireland as certain
restrictions and additional call charges will apply.
12. Exclusion of Liability
Insofar as it is permissible by law, IrishTourism.com shall
not be liable for any injury, loss or damage, whether foreseen
or unforeseen, directly resulting from:- (a) any failure, interruption,
delay, suspension or restriction in providing the Service to
the Customer which is due to any act of God, government control
restrictions or prohibitions, any other act or omission of any
public or regulatory authority (whether local, national, international
or supranational), an act of default of any supplier, agent
or other person, strikes, work stoppages or labor disputes or
any other cause whatsoever which is beyond the reasonable control
of IrishTourism.com;
(b) any unlawful or unauthorised use of the rental phone by
the Customer or third parties;
(c) any claim arising out of any act or omission by the Customer,
its servants or agents or arising out of any reliance placed
by such persons on Call Content;
(d) any loss, theft or malfunction of the Customer's rental
phone and SIM card;
(e) any loss, theft or malfunction of the Customer's phone and
or SIM card purchased from IrishTourism.com;
(f) any claim arising in relation to the provision (or non-provision),
maintenance or use of telecommunications lines, channels, equipment,
networks or services or arising out of Calls being dropped for
any reason;
(g) any claim arising out of or resulting from the quality of
fitness for the purpose of, compliance with description of,
or compliance with sample of any goods supplied to a Customer
unless the Customer deals as a consumer within the meaning of
the Sale of Goods and Supply of Services Act 1980.
IrishTourism.com will not be liable for any indirect or consequential
loss or damage whatsoever, whether it is foreseen or unforeseen,
including but not limited to loss of profits, data, revenue,
business, anticipated savings or goodwill. Nothing herein shall
have the effect of excluding or limiting the liability of IrishTourism.com
for death or personal injury resulting solely from its act or
omission. Otherwise, any liability of IrishTourism.com to the
Customer pursuant to this Contract shall not exceed 200 euro
per claim.
IrishTourism.com shall exercise such reasonable skill and care
in the provision of the Service as may be expected of a reasonably
competent cell phone rental/ sales company. Except as expressly
provided in the Contract, all conditions, terms and representations
whether express or implied by law in relation to the provision
of the Service are excluded to the fullest extent permitted
by the applicable law.
13. Purchased equipment
(a) In the case where the Customer has purchased a cell phone
or sim card from the Company the following sections of the terms
and conditions are applicable : 3: Delivery 4: Late Delivery
12: Exclusion of Liability
(b) The Company will arrange for the Equipment to be repaired
or replaced as per the conditions of the warranty supplied with
the Equipment. The Customer will be responsible for the costs
of getting the Equipment to and from the Company, including
all applicable taxes and duties.
(e) If the order is cancelled before the rented cell phone is
shipped, a charge of 25 euro will be applied to the customers
credit card.
14. Phone Credit
As call credit issued is tied to the customers number, we cannot
offer any refunds to customers for any unused call credit. We
also cannot offer any refund for unused credit on calling cards.
